Federal Communications Commission – Declaratory Ruling on COVID-19 Communications Under the Telephone Consumer Protection Act

On March 20, 2020, the FCC released a Declaratory Ruling confirming that the pandemic caused by the novel coronavirus qualifies as an emergency under the Telephone Consumer Protection Act (TCPA), after President Trump pronounced the COVID-19 outbreak a national emergency. As a result, hospitals, health care providers, health officials, and other government officials may use automated calls and text messages to communicate information about COVID-19 when “necessary to protect the health and safety of citizens,” without violating the TCPA.

The ruling specifies two primary conditions for the communication. First, the caller must be from a hospital, or be a health care provider, state or local health official, or other government official as well as a person under the express direction of such an organization and acting on its behalf. Second, the content of the call must be solely informational, made necessary because of the COVID-19 outbreak, and directly related to the imminent health or safety risk arising out of the COVID-19 outbreak.

Student Privacy During the COVID-19 Pandemic

School administrators are facing tough privacy questions as COVID-19 continues to spread across the world. Administrators in both preK-12 and higher education are grappling with how to inform communities and public health officials of infections that may emerge among students, how to respond to those cases, and how to maintain students’ privacy during communications. This resource is meant to supplement the recently published guidance from the US Department of Education (USED) on how the Family Educational Rights and Privacy Act (FERPA) applies to schools in the context of COVID-19.

March 2020 – Department of Education: FERPA & Coronavirus Disease 2019 (COVID-19) Frequently Asked Questions (FAQs)

The U.S. Department of Education issued Frequently Asked Questions regarding the Family Educational Rights and Privacy Act (FERPA) and COVID-19. The Department’s Student Privacy Policy Office (SPPO) prepared this document to assist school officials working with public health officials in managing public health issues related to COVID-19, while protecting the privacy of students’ education records. Understanding FERPA helps enable school officials to act quickly and with certainty when confronting challenges that affect the health or safety of students or other individuals.
